I agree that would feel right, but the rules are pretty clear here:
A target is an active soldier or vehicle
So LOS doesn't have anything to do with whether or not something is a target. Usually German paragraphs work around this by saying "if active target in sight" but in this case it doesn't mention that, so the solider can't perform the action.
